AGT Seed Sharing Licence Agreement 



When you purchased seed of Australian Grain Technologies (AGT) wheat variety's Correll, Gladius, Espada, Axe, Mace and Fang from a recognised seed retailer, we gave an undertaking we would offer you the legal right, under the terms of a Licence Agreement, to sell or trade grain from these varieties to another grower for use as seed under our new Seed Sharing model.  Please note Correll is not available for Seed Sharing in Western Australia.

AGT has great pleasure in offering you (the "Seller") the legal right to sell or trade seed of these varieties to another grower referred to in the attached Licence Agreement as the "Purchaser" at a price or arrangement agreed to between you and the Purchaser.

 AGT requires a signed 'AGT Seed Sharing Licence Agreement' to be completed by yourself (the "Seller") and the person/business to whom you wish to sell or trade the seed (the "Purchaser"). If the purchaser is a registered NGR card user, providing the NGR number will assist in ensuring the records relating to the specific business purchasing seed of the variety are accurate.

 This agreement should be completed and returned to AGT as soon as possible following the transaction between you the Seller and the Purchaser.  It is important to note that no seed can be legally traded without the return of a completed AGT Seed Sharing Licence Agreement. The sale or trade of seed without a completed and returned Licence Agreement is an infringement of Australian law under the Plant Breeders Rights ACT of 1994 and you, the Seller, would be liable.  This contract also provides a range of indemnities, disclaimers and releases included to provide you, the Seller, with a degree of legal protection. – refer section 7 to the attached Licence Agreement.

 So as to ensure a degree of seed purity and legal audit trail a grower who wishes to sell or trade seed of these varieties must have first purchased the original seed from a recognised retailer any time over the past three years. Growers who purchased seed through Seed Sharing in 2007/08 or 2008/09 are not permitted to on-sell any or part of the resultant 2009/10 crop as seed.

 It is also important to note that the Seller of seed is responsible for payment of the End Point Royalty on the total volume of seed of each variety traded not the Purchaser

 Before you (the "Seller") and the person/business to whom you wish to sell seed (the "Purchaser") complete the Licence Agreement, you should read it carefully and note its contents and your obligations under it.
